By accessing or using Practice—Process ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service, including visitors, registered users, and paying subscribers. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Practice—Process is a trading journal and analytics platform designed to help traders track, analyze, and improve their trading performance. The Service includes: - Trade logging and journaling features - Performance analytics and metrics - Session management and workflow tools - Strategy documentation and checklists - Data export and import capabilities The Service is a tool for record-keeping and analysis only. We do not provide financial advice, investment recommendations, or trading signals.

To use most features of the Service, you must create an account. When registering, you agree to: - Provide accurate, current, and complete information - Maintain and update your information as needed - Keep your password secure and confidential - Accept responsibility for all activity under your account - Notify us immediately of any unauthorized access You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

Your Data, Your Ownership You retain full ownership of all trading data, notes, strategies, and other content you upload to the Service ("User Content"). We do not claim any ownership rights over your User Content. License to Operate By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you. This license terminates when you delete your account. Data Accuracy You are responsible for the accuracy of the data you enter. The Service performs calculations based on the data you provide, and we are not responsible for errors resulting from inaccurate input. Prohibited Content You may not upload content that is illegal, harmful, threatening, defamatory, or that infringes on intellectual property rights.

You agree not to: - Use the Service for any illegal purpose - Attempt to gain unauthorized access to the Service or its systems - Interfere with or disrupt the Service or its infrastructure - Use automated systems (bots, scrapers) without permission - Share your account credentials with others - Resell or redistribute the Service without authorization - Reverse engineer or attempt to extract source code - Use the Service to harm or defraud others Violation of these terms may result in immediate termination of your account.

Free and Paid Plans The Service offers both free and paid subscription tiers. Features available to each tier are described on our pricing page. Billing Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through our payment provider and is non-refundable except as described in our refund policy. Automatic Renewal Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings. Price Changes We may change subscription prices with 30 days' notice. Price changes do not affect your current billing period. Refunds We offer a 14-day money-back guarantee on first-time subscriptions. After this period, subscriptions are non-refundable but you retain access until the end of your billing period.

Our Rights The Service, including its design, features, code, and documentation, is owned by Practice—Process and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding. Feedback If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use this feedback without obligation to you.

No Financial Advice THE SERVICE IS NOT A FINANCIAL ADVISOR. We do not provide investment advice, trading recommendations, or financial planning services. Any analytics, metrics, or insights provided are for informational purposes only. No Guarantee of Results Using the Service does not guarantee improved trading performance. Your trading results depend entirely on your own decisions and market conditions. Service Availability THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Data Accuracy While we strive to provide accurate calculations and analytics, we do not warrant the accuracy of any data or analysis provided by the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRACTICE—PROCESS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR: - Any indirect, incidental, special, consequential, or punitive damages - Any loss of profits, revenue, data, or business opportunities - Any trading losses or financial damages - Any damages resulting from your use of or inability to use the Service Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless Practice—Process and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Any content you upload to the Service

Your Right to Terminate You may terminate your account at any time by deleting it through Settings. Upon deletion, your data will be permanently removed as described in our Privacy Policy. Our Right to Terminate We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to notify you before termination unless prohibited by law or if termination is for cause. Effect of Termination Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive.

Informal Resolution Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Governing Law These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Venue Any disputes that cannot be resolved informally shall be resolved in the courts of New South Wales, Australia.

Entire Agreement These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Practice—Process. Severability If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Waiver Our failure to enforce any right or provision does not constitute a waiver of that right or provision. Assignment You may not assign your rights under these Terms without our consent. We may assign our rights at any time.
